U.S. Westinghouse appeals nuclear power plant ‘export control’ lawsuit against Korea Hydro & Nuclear Power

Westinghouse, an American nuclear power company that filed a lawsuit메이저사이트 to block the export of nuclear power plants to Korea Hydro & Nuclear Power (KHNP) but was dismissed, appealed the court ruling. According to the Washington DC

Federal Appeals Court on the 23rd (local time) , Westinghouse submitted its appeal on the 16th.

Previously, Westinghouse claimed that the Korean nuclear power plant that KHNP is trying to export to Poland and the Czech Republic used Westinghouse technology, which is subject to export controls under the U.S. Atomic Energy Act. A lawsuit was filed in October last year to prevent exports without U.S. government permission.

However, the Washington DC Federal District Court dismissed the case last month, saying, “Export control enforcement authority lies with the U.S. government, so Westinghouse, a private company, cannot be the subject of the lawsuit.”

Westinghouse announced its appeal policy in a statement the day after the dismissal decision.

Separately from this lawsuit, international arbitration proceedings are underway at the Korea Commercial Arbitration Board regarding the dispute between Korea Hydro & Nuclear Power and Westinghouse. Westinghouse continues to appeal the case and claims that it will protect its intellectual property rights by winning the Korean Commercial Arbitration Board arbitration.
